    The Senate Banking Committee markup produced the sharpest public articulation yet of Democratic opposition to the CLARITY Act, with Ranking Member Elizabeth Warren leading a sustained critique that framed the legislation as industry-captured regulation designed to benefit crypto insiders rather than protect consumers. "Nothing made it into this bill that wasn't approved by the crypto industry," Warren said in her opening statement, characterizing Republican support as an effort to "grease the skids" for Trump's "crypto grift." The ethics dimension was the most politically charged element of the markup, with Democratic Senator Chris Van Hollen introducing an amendment targeting Trump's potential conflicts of interest through World Liberty Financial and his family's memecoins. All 13 Republicans voted against the provision, with Senator Bernie Moreno and Scott defending the president and accusing Van Hollen of "ad hominem" attacks. Senator Raphael Warnock went further, withdrawing his own amendment while declaring he would not support any bill without explicit ethics carveouts, calling the situation "pure corruption."

    Senator Jack Reed argued the process itself was not genuinely bipartisan, accusing Scott of "arbitrarily" dismissing Democratic amendments rather than engaging with them substantively. Among the failed Democratic amendments: Reed's provisions on stablecoins and digital dollars, Catherine Cortez Masto's amendment to give law enforcement more authority over crypto cases, and Tina Smith's proposal to prohibit federal agencies from bailing out crypto companies during future market crashes. Warren also introduced an amendment citing Iran collecting crypto tolls for Strait of Hormuz passage and otherwise evading sanctions — a national security argument that connected crypto regulation to active geopolitical concerns. Senator Cynthia Lummis responded by arguing CLARITY already addresses crypto mixer regulation and is a "pro law enforcement" bill. The 15 to 9 vote outcome and the overwhelmingly partisan amendment record suggest the bill's path to 60 Senate floor votes will require meaningful Democratic persuasion that the markup session did not accomplish.
